Informational Session: Alice Smith, DEP Central Region
Stormwater/Phosphorous Presentation
Time: 7:00 PM
Alice Smith of DEP arrived at 7:35PM to present a workshop on Phosphorous loading and some other information and tools that would help the Commission in processing the filings that will result from the newly proposed EPA Phosphorous loading pilot program. She presented maps that DEP is currently developing that identify potential problem areas within the town that are in need of correction. Maps will be available by next week.

Attending the hearing were Bob Frazier, Ann McMenemy, Austin Turner, and Tom Sexton. After Cliff Matthews opened the continued hearing, Mr. Turner stated that TetraTech had met with peer reviewer Tom Sexton again and that they continue to make progress in addressing outstanding issues in the peer review comment letter relating to Category 3 as follows.
SM18 Pg 26, comment addressed. Ten foot access has been provided and will be reflected in the revised plans.
AM19 pg 27, comment addressed. Basin bottoms are pitched to encourage flow to the outlet structures
WP7 pg 28, comment addressed. Incorrect travel path footage was utilized pre and post cfs are within standards.
SWM4 pg 22 and SWM7 pg 23, comment addressed by revisions to O & M Plan
SWM7d pg 23, still pending. Tom Sexton and Austin Turner will review the soil logs. We do not have three soil tests per basin. Cliff reviewed the revised plans Subsurface Exploration Plan Sheet 2 of 2 to determine the accuracy of test pit data for detention ponds R3 and R4. There are not test pits on R4. R4 will require substantial excavation and currently the proposed basin bottom is 15 feet in elevation above the wetland.
SM3 Pg 24, still pending. A determination needs to be made if the sump, trash rack and increased maintenance will be sufficient to overcome the Commission’s concern that such a small orifice will be subject to plugging.
SM10 pg 25, Comment addressed by revisions to O & M Plan.

SM17 pg 26, Comment addressed by revision to O & M Plan by installation of drain gate valve.

SM 11 pg 26, Comment addressed. Calculations assumed frozen conditions and plugged outlet.
Bob Frazier provided an update on the Mass DOT project. Senator Moore’s office has been enlisted to assist in moving the interchange design and/or implementation forward. That project status, however, has no bearing on the filing before us. Cliff Matthews then stated that at the next continuation, we can commence with Category Two items. Motion was made, seconded and voted unanimously to continue the hearing to Wed. Dec. 14th at 7:30 PM for one hour.

Elliot Paturzo was present when Barry Lariviere opened the hearing. Mr. Paturzo presented the proposed septic system repair plan, He stated that the existing system is failing and needs replacement. The proposed system will require installation of a septic tank and leach field. The Board of Health granted four local upgrade waivers: distance to wells100 feet to 91 feet, distance to foundation 20 to 10, distance to Box Pond of 43 feet from 50 feet and space separation to groundwater to three feet. A 40 mil barrier is proposed to protect the foundation. Stockpiling of materials will take place in the front of the existing dwelling. The total proposed grade change will be approx. six inches. There were no further comments or questions. The Commission voted unanimously to close the hearing and issue an Order of Conditions.

Gregory Prew was present when Cliff Matthews opened the meetings. Mr. Matthews stated that several of the Commission members visited the site the past week. Mr. Prew stated that he would like to place a shed on an area that he had recently prepared by removing some downed trees and brush that resulted from Tropical Storm Irene. He then brought in some fill and small stone to prepare the area for a shed located just off the turnaround on his driveway. Cliff stated that the fill was placed in a resource area and proceeded to show Mr. Prew where the resource area line may have previously existed before the filling, which was, he stated, only an estimate. Cliff stated that the function of a wetland is to attenuate pollution and this is accomplished through plant uptake of pollutants. Mr. Prew said that he had purchased the property a
few years ago and has since removed quite a large amount of trash and debris in the wetland that the previous owner had left. Commission members agreed that the fill should be removed from the wetland. Several ideas were discussed as alternatives for Mr. Prew to place a shed in or near the area if he were to replicate the wetland. Mr. Prew stated in his RDA that he would be amenable to replication if

it became necessary. Ideas included removing the stone and placing a wall to support the shed; removing the fill beyond the stone and placing the shed on the turnaround on the driveway; and placing the shed on sono-tubes. All of these suggestions were not feasible. Mr. Prew and the commission agreed to visit the site again on Sat., Nov. 19th . Mr. Prew indicated his willingness to cooperate with the Commission even if he were issued an Enforcement Order to replicate the resource area. Mr. Prew will stake the area where he wishes to place the shed for that site walk. The meetings were continued to Wed., Dec. 14th at 8:30 PM by unanimous vote.

Cliff Matthews opened the meetings and stated that the applicant has requested a continuation to December 14th, 2011. Town Counsel and Counsel for Mass DOT have been corresponding relating to the issue of whether or not Mass DOT must file under the local bylaw. By unanimous vote, the meetings were continued to Dec. 14, 2011 at 8:35 PM

Site walks were set up for Sat. Nov. 19th, 2011 at 8:30 AM beginning at Bellingham Estates. Toll Bros. has requested follow up site walks in preparation for the issuance of a Certificate of Compliance. The second site walk will be the detention basin at Bucky Drive to see if the basin is in need of maintenance. The third site walk will be 15 Mann St..
Cliff Matthews stated that the soil logs and repairs for the Pulaski Blvd. basins as performed by Phil Paradis of BETA have been reviewed by Tom Sexton. Tom has suggested that he not continue his review until better suggestions are made by BETA to address the corrections in the design. Cliff will contact Don DiMartino tomorrow to discuss.
Cliff reported that he contact Jay Talerman regarding the drafting up of a revocable lease with Mr. Rhodes of Lake St. Auto to address a long term violation on Commission property.
Commission members were reminded to complete the conflict of interest tests and submit to the Town Clerk.
The MACC Annual meeting will be held on March 5, 2012.
By unanimous vote, the meeting of December 28th was cancelled due to the holidays.
Anne Matthews is working on creating an Application for Permit and permit information packet for filing under the local bylaw.
Cliff Matthews reported that Cumberland Farms, 340 South Main Street has requested return of the replication bond (DEP #105-590). The Order of Conditions will expire in December. The Commission

agreed to issue a Certificate of Compliance stating that the work never commenced and once the recording information of the document is received by the Commission, release the bond to the applicant.
